These Terms govern access to and use of PingTab, including the dashboard, driver app, public tracking pages, APIs, and related services. If you use PingTab on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.
1. The Service
PingTab is an operational trip tracking and transportation visibility tool. It is not an emergency response service, navigation provider, transport provider, insurer, or substitute for dispatch judgment.
2. Accounts And Organization Access
Users must provide accurate account information, protect their credentials, and access PingTab only through authorized accounts. Organization administrators are responsible for managing users, roles, organization settings, trip data, and access to tracking or driver links.
You are responsible for all activity under your account and for promptly removing access from users who should no longer be part of your organization.
3. Trip, Driver, And Customer Data
You are responsible for the accuracy, legality, and appropriateness of the trip, customer, passenger, driver, vehicle, location, notes, itinerary, and branding information you enter into PingTab. You must have the rights, permissions, and notices needed to process and share that information through the service.
You should avoid entering sensitive personal information into trip notes, itinerary fields, names, or other free-text areas unless it is necessary for the trip and lawful for you to provide.
4. Driver Location And Safety
PingTab may process precise driver location when location permissions are enabled for an active trip. Drivers and organizations are responsible for complying with applicable laws, employment policies, and consent requirements related to location tracking.
Drivers should not interact with the app in an unsafe way while driving. Organizations remain responsible for dispatch decisions, route decisions, passenger communications, and emergency escalation.
5. Public Tracking And Driver Links
Tracking links and driver links are bearer-style credentials. Anyone with an active link may be able to access linked trip information or submit driver updates. You are responsible for sharing links only with intended recipients and for regenerating or deactivating links when access should change.
6. Acceptable Use
- Do not use PingTab for unlawful, deceptive, abusive, harassing, or discriminatory purposes.
- Do not use PingTab to track a person outside a legitimate trip or without required authorization.
- Do not attempt to bypass authentication, role controls, token protections, rate limits, or security measures.
- Do not upload malicious code or interfere with the service, infrastructure, or other users.
- Do not reverse engineer, scrape, copy, or resell the service except as allowed by law or a written agreement.
- Do not use PingTab to send spam or unauthorized communications.
7. Third-Party Services
PingTab may use or integrate with third-party services for hosting, storage, maps, authentication, email, SMS, app distribution, analytics, and error monitoring. Those services may have their own terms and policies. PingTab is not responsible for third-party products that are not controlled by PingTab.
8. Fees, Trials, And Billing
If you use a paid plan, you agree to pay the fees, taxes, and charges described in the applicable order, plan, invoice, or checkout flow. Pricing, usage limits, trials, and billing terms may vary by plan or written agreement. Except where required by law or stated in a written agreement, fees are non-refundable.
9. Service Changes, Availability, And Suspension
We may update, improve, limit, suspend, or discontinue parts of PingTab. We may suspend or restrict access if we believe an account or organization is violating these Terms, creating security risk, causing service disruption, failing to pay applicable fees, or exposing PingTab or others to legal or operational risk.
10. Intellectual Property
PingTab and its software, design, documentation, and branding are owned by PingTab or its licensors. You retain ownership of the data and content you provide to the service, and you grant PingTab the rights needed to host, process, transmit, display, and protect that content to provide the service.
11. Confidentiality
Non-public product, security, pricing, business, or technical information exchanged through PingTab or related support channels must be treated as confidential unless it is already public or independently known without restriction.
12. Disclaimers
PingTab is provided on an as-is and as-available basis to the maximum extent permitted by law. We do not guarantee uninterrupted service, error-free operation, exact location accuracy, route accuracy, arrival times, delivery of third-party messages, or that the service will meet every operational requirement.
13. Limitation Of Liability
To the maximum extent permitted by law, PingTab will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or transport-related losses. PingTab's total liability for claims relating to the service will not exceed the amounts paid to PingTab for the service in the three months before the event giving rise to the claim, or the minimum amount permitted by law if no fees were paid.
14. Indemnity
You will defend and indemnify PingTab from claims, damages, liabilities, costs, and expenses arising from your use of the service, your data, your violation of these Terms, your sharing of tracking or driver links, or your failure to obtain required rights, notices, permissions, or consents.
15. Termination
You may stop using PingTab at any time. We may terminate or suspend access as described in these Terms. After termination, provisions that by their nature should survive will continue, including payment obligations, confidentiality, intellectual property, disclaimers, limitations of liability, and indemnity.
16. Governing Terms
If your organization has a signed agreement or order form with PingTab, that agreement controls where it conflicts with these Terms. Otherwise, these Terms are the agreement between you and PingTab for use of the service. If a specific legal jurisdiction is required for your deployment, it should be stated in the applicable written agreement.
17. Changes To These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new last updated date. Continued use of PingTab after changes become effective means you accept the updated Terms.
